As more firms “take the plunge” to go paperless, they need to understand both the practical and legal consequences of a truly paperless office. With the recent successful passage of the ACEC statute of repose bill, the time periods for retaining documents on most Minnesota projects have become clearer. However, licensing and client considerations make a detailed document retention policy as important as ever. This discussion will focus on the legal considerations and give tips for developing an effective document retention policy which meets the expectations of the courts, public clients, and the regulators.
Presenter: Eric Heiberg is a partner at the law firm of Heley, Duncan & Melander, PLLP. He has advised design professionals for over 15 years on general liability and business issues as well as represented them in significant claims litigation. Eric routinely advises his clients during complicated projects regarding proper project documentation and process, and has helped dozens of firms create and implement document retention policies and procedures which meet both their legal responsibilities and their business goals.
